By accessing or using VisangCare's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Description of Services

VisangCare provides hotel worker safety solutions, including panic button devices, monitoring software, and related services designed to help hotels comply with Washington State HB 1524 and similar regulations.

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. Subscription and Fees

4.1 Pricing

Our services are offered on a subscription basis. Current pricing is available on our website or upon request. Prices are subject to change with 30 days notice.

4.2 Payment Terms

  • Fees are billed monthly or annually as selected
  • Payment is due upon invoice
  • Late payments may incur additional charges
  • All fees are non-refundable except as specified

5. Hardware and Equipment

Panic button devices and related hardware remain the property of VisangCare unless explicitly purchased. You are responsible for:

  • Proper use and care of equipment
  • Reporting damage or malfunction promptly
  • Returning equipment upon contract termination
  • Replacement costs for lost or damaged equipment

6. Service Level Agreement

We commit to:

  • 99.9% system uptime
  • Real-time alert delivery
  • 24/7 technical support for critical issues
  • Regular system updates and maintenance

7. User Responsibilities

You agree to:

  • Use services only for lawful purposes
  • Train staff on proper device usage
  • Respond to alerts in accordance with your safety policies
  • Maintain accurate staff and room information
  • Not attempt to reverse engineer or modify our systems

8. Compliance

Our services are designed to help you comply with HB 1524 and similar regulations. However, compliance ultimately remains your responsibility. We recommend consulting with legal counsel regarding your specific compliance obligations.

9. Intellectual Property

All intellectual property rights in our services, including software, designs, and documentation, remain with VisangCare. You receive a limited, non-exclusive license to use our services during your subscription period.

10. Limitation of Liability

To the maximum extent permitted by law, VisangCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless VisangCare from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

12. Termination

Either party may terminate this agreement with 30 days written notice. VisangCare may terminate immediately for material breach of these terms. Upon termination, you must cease using our services and return all equipment.

13. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in Seattle, Washington, in accordance with AAA rules. You waive any right to participate in class action lawsuits.

14. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated with 30 days notice. Continued use after changes constitutes acceptance of the new terms.

15. Governing Law

These terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles.
